Section 4
Before establishing a bank or financial institution, approval should be obtained

(1) For the purpose of Section 3, before submitting an application for registration of a bank or financial institution in accordance with the prevailing law, the concerned person or institution shall submit an application to the National Bank for prior approval along with the following documents attached to the National Bank:- (a) Proposed Bank or Financial Institution Articles of Association, (b) Regulations of the proposed bank or financial institution, (c) Feasibility study report of the proposed bank or financial institution, (d) Personal details of the applicant in the format prescribed by the National Bank, (e) Any agreement between the applicant to establish the proposed bank or financial institution. If so, a certified copy of such agreement, (f) details of the applicant's source of investment and proof of payment of taxes up to the previous financial year immediately before making the application in accordance with this section, (g) the applicant has not been involved in Damasahi in Nepal or abroad, has not taken a loan from any bank or financial institution , has not been blacklisted in any transaction with a bank or financial institution, details of whether three years have passed since it has been released, (h) no action has been taken against the applicant in Nepal or abroad for fraud, forgery, or an act considered to be an offense according to the prevailing law and in such criminal act Self-declaration that the applicant has not been punished, (j) The applicant has not been prosecuted by any regulatory or supervisory body or authority in Nepal or abroad, the license of the company or organization he is involved in has been suspended or canceled or has been or is not in the process of being rescinded, (j) Details of the applicant The name, surname and relationship of the family members and details of significant ownership or significant status and if they have worked as a director, officer or employee in an organization, the details of each person's status as well, however, if the applicant is an organized organization, the person who has significant ownership or status in that organized organization. Details, audited financial statements of the last three financial years and the tax payment certificate of the organization should also be attached. (k) ApplicationA written authorization given to the National Bank to investigate or conduct an investigation regarding the financial and professional background or to exchange such information and information, (l) Commitment to protect deposits up to the limit specified by the National Bank, (d) Other details and documents specified by the National Bank from time to time. (2) According to sub-section (1), if it is found appropriate to give approval after examining the application received for prior approval and the documents attached thereto, the National Bank may give prior approval for the establishment of such bank or financial institution within one hundred and twenty days of the receipt of such application, with or without specifying any conditions. (3) Notwithstanding anything written in sub-section (2), prior approval shall not be given to a firm or company in which the following persons and their family members have substantial ownership to establish a bank or financial institution:- (a) under regulatory action of the National Bank, (b) in banking offences. (c) Convicted for fraud, forgery, fraud, (d) Convicted for money laundering and financial investment in terrorist activities, (e) Convicted for corruption, (f) Human trafficking, kidnapping, kidnapping, extortion Convicted for crimes of a serious nature.
